1. General Conditions & Eligibility

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

2. Products, Pricing, and Accuracy

  • Food & Dietary Information: Totes manufactures and sells packaged food items (including but not limited to baked peanut puffs). All nutrition facts, ingredient lists, and allergen information are provided on the packaging and product pages. While we strive for absolute accuracy, you are advised to read packaging labels carefully before consumption, especially if you have severe food allergies (e.g., peanut allergies).

  • Pricing: Prices for our products (e.g., ₹60 per 70g pack) are subject to change without prior notice. All prices displayed on the website are inclusive of applicable taxes (GST) unless stated otherwise.

  • Modifications: We reserve the right at any time to modify or discontinue any Product or Service (or any part or content thereof) without notice at any time.

3. Orders and Payment

  • Order Acceptance: We reserve the right to refuse or cancel any order you place with us for reasons including but not limited to: product availability, errors in product or pricing information, or suspected fraud.

  • Payment Methods: We accept payments via credit/debit cards, NetBanking, UPI, wallets, and cash on delivery (where applicable) through authorized Indian payment gateways (such as Razorpay/Cashfree). By submitting payment information, you authorize us to charge the designated amount.

  • Subscriptions: If you opt for a recurring monthly subscription (e.g., 30 packs for ₹1650/month), you authorize automatic recurring billing on the scheduled date until you pause or cancel your subscription through your account panel or by contacting support at least 48 hours prior to the next billing cycle.

4. Shipping and Delivery

  • Deliveries are fulfilled via third-party logistics partners across serviceable pincodes in India.

  • Estimated delivery timelines will be communicated at checkout or via order tracking links. Delays caused by weather, festive rushes, transport strikes, or operational bottlenecks outside our control are not grounds for order cancellation once dispatched.

5. Return, Replacement, and Refund Policy

Due to the perishable and edible nature of packaged food items, we do not accept returns or exchanges for change of mind or personal taste preferences.

  • Damaged or Incorrect Items: If you receive a damaged package, expired product, or an incorrect item, please notify us within 48 hours of delivery by emailing hello@eattotes.com or WhatsApping +91 8169077278 with:

    1. Your Order ID

    2. Clear photos/videos of the outer box, shipping label, and damaged product.

  • Refund Processing: Once verified, approved refunds will be credited back to your original payment method within 5–7 business days.

6. Intellectual Property

All content included on this site—such as text, graphics, logos, images, packaging designs, slogans ("Zero-Grease", "Totes"), audio clips, and digital downloads—is the property of DVC Foods LLP and protected by Indian and international intellectual property laws. Unauthorized copying, reproduction, or commercial misuse is strictly prohibited.

7. Limitation of Liability & Disclaimer of Warranties

  • We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

  • In no case shall DVC Foods LLP, our partners, officers, employees, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind resulting from your consumption of our products or use of our website beyond the total purchase value of your order.

8. Governing Law & Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.
